The Special School for SCS is a red herring! The attempts to get a Special School District is nothing new. Even if it was, it would still require the General Assembly to remove the state wide ban. Though the GOP has significant control of the General Assembly, I don't believe they would remove ban. That type of move would be strongly opposed by all four of the large counties Shelby, Davidson, Knox, and Hamilton counties. That level of opposition would kill the bill in its tracks.

Here's the thing. According the the Germantown leadership, the private act that chartered the City of Germantown gives them the authority to have a school district. All it will take is the state lifting the state-wide ban on MSD and the Germantown board passing the necessary ordinances/laws. No vote by the citizens is required for a MSD in Germantown or Collierville.

Great article. Politically, I disagree with most of the issues supported by the Flyer. However, I enjoy reading it because the level of writing and coverage the Flyer offers is head and shoulders above that offered by the larger Memphis publication.

I oppose the consolidation mainly because I don't believe a school district that size would improve the education of those already being under served. That being said, there is no place for this racial us verses them mentality on either side of the debate. This type of belief system and rhetoric (both in the white and black communities) has held Memphis back and caused it to lag severely behind. Let's debate the pros and cons of school consolidation but stop using race to stir the pot.

Just because Memphis residents makeup 70% of the population, it does not necessitate that they provide 70% of the tax revenue. I didn't the numbers for Shelby County taxes collected for eduction in 2008. Though some generous assumptions were given to Memphians' contributions to the wheel tax, the numbers show that only 66% of the taxes for education came from Memphis. Its a safe assumption that this percentage can be extrapolated the all taxes collected in the county.

A federal court in 1997 told the voters inside Memphis that they couldn't participate in the election of Shelby County School board members. Based on this a court did tell a majority of the voters in a county that they could not participate in a portion of "their government." Here's the case - Board of County Commissioners of Shelby County Tennessee v. W Burson.

I see don't place the blame on the lunatic. He's a simple victim of the talk radio. That is one of the most moronic argument I've ever heard.

Based on that logic the Beatles are to blame for the Manon murders because Charles Manson believed the song Helter Skelter contained hidden meanings. Gangster rap artists are to blame for violence against women or gang violence, which their songs glorify. Did this murderer ever play video games like "Hitman" or "Call of Duty?" Maybe that's where he learned to shoot a gun, so the makers of those games are suspects for blame too.

Do you see how idiotic this line of "reasoning" is?

"How can a Judge rule without hearing all of the evidence from both sides."

The judge has the power to do this under Rule 12(b) of the Federal Rules of Civil Procedure. It's called a "motion to dismiss" and was likely filed by the defense based on "Failure to state a claim upon which relief can be granted." In this type of motion, the defendant argues that the facts set out in the plaintiff's complaint are not enough to warrant any remedy under the law.
