      <![CDATA[I know you guys don't get out to Bartlett much but it is the 10th largest city in the state? The money is there, the tax rate could be doubled and it'd still be cheaper than the current Memphis property tax.

      <![CDATA[Fair enough, but they would still have to pay for the real property, then there would be the costs of the books, hardware, establishing the infrastructure, the list goes on. Even if the buildings are sold at a pro-rated price to account for previous tax dollars invested in them (as I've heard would be the case) Bartlett has had a declining student population.

      <![CDATA[Remember that for operations, any new suburban city school systems would receive at least the same per pupil funding from the state and county that the Shelby system receives today. And it might even be higher than the county system currently receives.

   It could be explained much better by a lawyer, but:  A part of the challenge to Norris-Todd charged that the law was unconstitutional because the section on creating new  special or city school districts was not covered in the caption of the law. The judge said the law has a severability clause which basically says if any section of the law is declared to be unconstitutional it could be severed from the rest of the law and doesn't make the other parts of the law unconstitutional.

      <![CDATA[I'm still at a loss to understand the judge's ruling on the constitutionality of Norris-Todd as it pertains to the establishment of special school districts. As I understand it, he said, in essence, that claim wasn't "ripe" for adjudication and wouldn't be until someone tried to form such a district.

If a county special school district is eventually established -- and I believe it will be -- or some special suburban districts are set up, the special district or suburban city districts would receive, in addition to a proportional share of county and state school operating operating funds, an ada share of all construction bond funds issued for the new county system, which would consist entirely or primarily of the current Memphis schools.
