      <![CDATA[OTP, I am pretty confident that not ALL of the munis in a county have to meet the minimum population requirement, just one.<br>
<br>
If you'll recall, Millington has to annex Lucy or some other residents to be able to meet the minimum requirement for an MSD under Norris-Todd. In other words, not ALL municipalities in Shelby County met the minimum requirement when Memphis surrendered its charter, but Norris-Todd still applied to Shelby County.<br>
<br>
In other words, all you need is the ability for ONE of the municipalities to meet the minimum requirements under Norris-Todd AND a SSD surrender large enough comparatively to meet the requirement to trigger Norris-Todd.

That would be my guess also. In fact..<br>
<br>
 I am quite suprised he does not just dismiss the case, read all the postings on this board and make his decision from the wealth of legal opinion to be found here.<br>
<br>
I am also guessing he recognizes outright that my opinions are more reasoned, are reliably based on  sound interpretations of existing law and precedent, and thus have more merit than those of anyone else.

      <![CDATA[As an aside, I love how the General Assembly's expert isn't a real expert because the facts she presents don't fit what the SCC wants to hear. I completely understand the need to delay<br>

Also, I think the SCC could get into serious trouble if they try to dispose of the state's expert witness.

Bernice's vote will be exactly as our unlearned friend says. She is possibly the worst Federal judge ever to sit in the Wesrern District, and if memory serves, the most overturned on appeal.

      <![CDATA[Just curious how you know Bernice Donald's ruling would be an affirmative for the SCC? Is she completely politically driven to the point where she doesn't consider the law, the previous ruling, or the parameters that surround the ruling and why it was made in such a way?<br>
<br>
I realize that most judges have some political leaning, but I would HOPE that most federal judges would actually consider the facts on every case and not have a pre-determined judgement based on their political leaning without even examining the case.
