Once a state law is passed, if implemented, would have a disparate impact on minorities, it can be stopped from being implemented. That is the remedy itself.

If the present lawsuit is only against the state, why are the munis counted among the defendants?

Once a law is passed out of the legislature and signed by the Governor, what else must happen before the law is considered "operating" or "in effect"?

If remedies from the bench are only made to correct harms already done, why is the SCC suing over a potential harm? What harms have already been done by the munis in Shelby County?

Can a lawsuit be brought against one enity ( the state) for some potential harm another entity ( a city) might possibly do sometime in the future?

The 14th amendment challenge is already against the state. This present lawsuit is against the state, not the munis.

You are naive about the remedies that a federal judge can order.

Just a tidbit of info that I picked up yesterday.

Are you aware that the MCS has money for tuturing of parents of students. They were allocated enough Title 1 money to tutor 22,178 parents; guess how many they have in tuturing class, 2,200.

Yeah, I agree.

This thing has become ego-driven, by a bunch of people with very large egos, too.

Maybe the Special Master can help with that in the merger.

Maybe, just maybe, the two sides can get back together at the negotiation table and get this damn thing settled. It just seems that the prevailing attitude is to win at any cost, the cost in this case being the educational welfare of a lot of kids.

The part of Norris 1 that set up the TPC was ruled constitutional. The third part, lifting the ban on msds only in Shelby County is what is now awaiting a ruling.

A favorable judgement for the SCC on any 14th Amendment issue will nullify no laws. It only means that the particular implementation of those laws on the part of each and every municipality (remember that each municipality individually must be found in violation, this is not a collective judgment) in Shelby County does not meet Judge Mays approval.

Ken Hoover has all the data, and as I remember, that will be a tough nut for the SCC to crack in the case of most of the municipals.

Moverover, the Judge has power to remedy any violations he may find and then let the municipals go forward.

We shall see, I suspect we have a way to go before that challenge is heard.

Given the rather stringent state requirements for any municipality to form its own system, along with the financial cost, I really don't see any possibility of that happening.

As I posted earlier, both the Knox County system and the Hamilton County system have excellent schools that are performing very well.
