I keep bringing up the Robertson problem, not as a comparison to the problems of our schools, but to show how serious a title vi complaint is and how easy and inexpensive it is for any resident of Tennessee to file.

It is nothing to be taken lightly and the Justice Dept and the Office of Civil Rights do investigate vigorously.

I know that civil rights advocates has made this their weapon of choice in attacking states, counties, and local school districts. This is being done as a way around recent supreme court rulings that have sharply curtailed the chances of winning in court, resegregation.

It was not to equate the two problems as similar.

•The funds generated by the BEP are what the state has defined as sufficient to provide a basic level of education for Tennessee students. This basic level of funding includes both a state share of the BEP and a local share of the BEP.

•The BEP has three major categories (instruction, classroom, and non-classroom), each made up of separate components related to the basic needs of students, teachers, and administrators within a school system.

•Student enrollment (average daily membership) is the primary driver of funds generated by the BEP.

•There are 45 BEP components most of which are based on student enrollment (ADM).

You will see that the per pupil funding from the state varies from system to system.

As I have said before I am not the sharpest knife in the drawer on the funding and constitution stuff. But to this feeble one the ADA seems to be one of the fairest of the systems.

Every child in Shelby County will get the same amount of funding, regardless of which LEA they attend. That is what ADA means.
