SpaceXAI wants to buy real estate from Southaven residents.

MZX Tech LLC, an affiliate of  SpaceXAI, sent letters outlining an offer to purchase property from locals. If residents agree, they will not be allowed to join the class action lawsuit against the artificial intelligence company.

The letter entitled “Notice of Noise Nuisance Litigation Related To Southaven Purchase Offers,” details the claims made in the lawsuit Haley et al v. X.AI Corp. et al. The suit, filed by Southaven residents Jason Haley, Preston Herrington, and Taylor Logsdon, stemmed from noise complaint issues generated by the plant located at 2875 Stanton Road.

Residents alleged that the gas turbines used to power SpaceXAI’s data center create noise described as “ a combination of high-pitched squealing, continuous engine roaring, low-frequency rumbling, and tonal humming or whining.”

One resident claimed they experienced sleep loss, headaches, and persistent ringing in the ears as a result.

The suit encompasses claims of private and public nuisance, negligence, negligence per se, and negligent infliction of emotional distress. Residents asked the courts to order a reduction of noise at the plant, while also requesting monetary damages.

“MZX denies all of the allegations against it,” the letter said. 

“However, because MZX also requires property for its proposed business, MZX, through its real estate broker, is offering to purchase real estate in Southaven in exchange for, among other things, a release of all claims related to the lawsuit.”

Those who take up MZX Tech’s offer, will be asked to sign a real estate contract with a “separate release agreement at the closing of the real estate transaction.” They will also not be allowed to join the lawsuit or collect any damages from the suit.

Residents would also not be able to bring litigation on their own behalf.

“Accepting a purchase offer and agreeing to the release agreement is fully voluntary,” the letter said. “You may choose to accept MZX’s offer and sign the release or you may choose not to do so.”
